Man accused of several rapes, let go, now back in jail

CHARLOTTE, NC (WBTV) - The neighbor who helped Lavatae Evans' latest alleged victim is sharing her story with WBTV. Evans, 32, was arrested for the third time in six months for sexual assault.

He was picked up by officers Wednesday, and charged with five counts of second degree rape and second degree kidnapping.

The unnamed victim told investigators she met Evans at the Charlotte Transit Center, and went home with him. That's when she claims Evans sexually assaulted her.

The victim said she was only able to escape after jumping out a window, and running to neighbor Sharon Churchill's home for help.

"Right away we knew who she was talking about. There's been several rapes in that house," Churchill said.

Records show in December, Evans was questioned for sexually assaulting two women. He was let go. Later the same day, he was arrested after allegedly sexually assaulting a third woman. 

Former CRVA chief arrested for DWI

CHARLOTTE, NC (WBTV)- The former chief executive of the Charlotte Regional Visitors Authority was arrested for driving while impaired Tuesday, according to the Mecklenburg County Jail.

Timothy Edward Newman, 47, was arrested by the NC Highway Patrol and charged with driving while impaired and hit and run causing property damage, according to the jail.

The arrest affidavit list Newman's blood alcohol level as 0.14.

The incident was reported along Interstate 77 at 10:08 p.m.

Newman left the CRVA in February, after he was demoted to a sales position.

Charlotte City Council had withheld public funds from the CRVA after a report from PricewaterhouseCoopers raised questions about how funds were being used to pay for employee expenses.

The CRVA hired former hotel development executive Tom Murray in December to run the organization.

Appeal denied for man found guilty of killing two CMPD officers

CHARLOTTE, NC (WBTV)- A man who shot and killed two Charlotte police officers in northeast Charlotte in 2007 has been denied an appeal to overturn his murder conviction.

In September 2010, Demeatrius Antonio Montgomery was found guilty of two counts of first-degree murder in the slaying of Officers Sean Clark and Jeff Shelton at the Timber Ridge Apartments in east Charlotte in 2007.  He is currently serving two consecutive life sentences without parole.

His new attorney filed an appeal, 217 pages long, in September 2011 in an attempt to get the conviction overturned. Several of the 16 reasons for appeal deal with Montgomery's mental competency.

The court ruled that the appeal was without merit and that the trial court did not err in procedure.

However, Montgomery's appellate defender, Andrew DiSimone said he is reviewing the possibility of filing a petition with the NC Supreme Court.

Man wanted in five NC bank robberies arrested in TN

CHARLOTTE, NC (WBTV) - Federal agents in Charlotte arrested a man Tuesday they say has robbed five banks across the state including one last week in Raleigh.

Clyde Allen Nixon, 60, was was taken into
custody Tuesday morning at approximately 10:30 a.m. by the Kingsport Police
Department in Kingsport, Tennessee, according to the FBI. 

Officers received information
regarding Nixon's location and when they tried to take him into custody he fled
the scene in a vehicle. He was arrested a short time later and is now facing
charges in Tennessee in additional to numerous charges related to bank
robberies in North Carolina.

Nixon is currently being held in the
Kingsport Police Department's holding facility.

Police: 2 attorneys from DA's office assaulted in cemetery

CHARLOTTE, NC (WBTV) - Two assistant district attorneys for Mecklenburg County were assaulted Saturday evening in uptown Charlotte.

The incident was reported along the 700 block of West 6th Street inside Elmwood Cemetery, according to the report from the Charlotte-Mecklenburg Police Department.

They were assaulted by an unknown person with a 2x4 piece of wood.

The man had sever lacerations to his head and had to be taken to Carolinas Medical Center for treatment, according to the report.

The woman sustained minor injuries and was not taken to the hospital.

The attorney's work on misdemeanor crimes inside the District Attorney's Office.

DNC protesters could be armed during the convention

TAMPA, Florida (AP) - The thousands of protesters expected at the Democratic and Republican national conventions can come armed with a lot more than signs and slogans: State law in Florida and North Carolina allows concealed weapons, including guns.

In Tampa, where the Republicans will hold their festivities this fall, officials are starting to worry about people toting guns in such a politically charged environment. The City Council voted Thursday to ask Republican Gov. Rick Scott to help them temporarily ban concealed weapons. Charlotte officials have yet to publicly voice concern, but with both cities trying to balance public safety with First and Second Amendment rights, it's likely the host city for the Democratic convention will also have to address the issue.

The Tampa City Council wants Scott to issue an executive order, preventing people with concealed weapons permits from carrying guns.

Leader of UNC-Charlotte marijuana ring sentenced to federal prison time

CHARLOTTE, NC (WBTV) - A Charlotte man convicted by a federal jury on drug, money laundering and firearm charges was sentenced to 196 months in prison today, announced Anne M. Tompkins, U.S. Attorney for the Western District of North Carolina. Chief U.S. District Judge Robert J. Conrad, Jr. also ordered Eric Mark Giles, 40, of Charlotte, to serve four years of supervised release following his prison sentence.

The same jury also convicted Giles' co-defendant, Kyle Corsi, 38, of Charlotte, for his participation in the drug distribution ring. Judge Conrad sentenced Corsi to 120 months in prison and five years of supervised release for his participation in the drug conspiracy.
